Five Star Camera (hereinafter referred to as "the Company") establishes the following Terms of Use and Membership Agreement.

Article 1 Scope and Amendments to These Terms and Conditions

  1. These Terms and Conditions shall apply to the use of this service by the Company, Members (as defined in Article 3), and Purchasers.
  2. The Company may, without obtaining prior consent from Members, change all or part of these Terms and Conditions at any time by notifying Members through methods deemed appropriate by the Company, such as posting on the website or via email.
  3. If these Terms and Conditions are changed, only the amended Terms and Conditions shall apply to the content, timing, target users, and terms of use of this service, and Members shall abide only by the amended Terms and Conditions.

Article 2 Use of the Service

  1. Members shall use the Service in accordance with these Terms and Conditions and other rules set forth by the Company, such as the Privacy Policy and Usage Guidelines.
  2. Minors may not become members or use the Service without prior consent from a parent or guardian.

Article 3 Definitions

  1. "Member Services" (hereinafter referred to as "the Service") refers to the services provided by us to members (as defined in the next paragraph) through our website, [fivestarcamera.net].
  2. "Member" refers to an individual who possesses the membership qualifications stipulated in Article 4, agrees to these Terms and Conditions, completes the membership application procedures specified by us, and is approved by us as a user of the Service.

  3. When making payments by credit card, members must comply with the regulations prescribed by the credit card company (hereinafter referred to as "Credit Card Company") that issued the credit card selected by the member.
  4. If we approve a membership application, we will send a registration confirmation email to the applicant, and upon receipt of said email, the applicant will be registered as a member.
  5. Even for members whose membership has been approved, if any of the reasons listed below are discovered after approval, we may, without prior notice, suspend their use of the Service, delete their membership registration, or take any other measures deemed appropriate by us.
    1. If it is found that the member had previously been subject to measures such as membership deletion due to a violation of the terms of any service provided by us.
    2. If the membership application contains false information.
    3. If there is a delay in the performance of payment obligations for fees related to the Service, an inability to receive products or services (hereinafter collectively referred to as "Products, etc.") within a reasonable period, or any other default on obligations to us.
    4. If any other provision of these Terms is violated.

Article 5 Management of ID and Passwords

  1. Members shall be solely responsible for the management of the User ID and password they set themselves when registering as a member.
  2. Members shall not transfer, assign, lend, disclose, or leak their User ID and password to any third party without the prior consent of the Company.
  3. If a member discovers that their User ID and password are being used illegally by a third party, they shall immediately notify the Company.
  4. Members acknowledge the risks of information leakage associated with payment methods, such as the act of transmitting credit card numbers when using this service, and shall strictly manage and use them at their own responsibility.
  5. Members shall be responsible for the management and use of their User ID, password, and credit card number, and shall bear responsibility for any unauthorized use by third parties or any other damages related to the management or use thereof, and the Company shall bear no responsibility whatsoever.

Article 6 Use of Personal Information

Regarding members' personal information that we obtain in connection with the use of this service, we will handle it in accordance with our separately established "Privacy Policy."

Article 7 Use of the Service

Members can receive this service free of charge. However, this does not apply to cases where paid services are provided in accordance with the provisions of Article 15, Paragraph 2, and to the purchase of products based on Articles 16 to 19.

  1. When using this service, members must comply with the provisions of these Terms and Conditions and use it only by the methods designated by the Company.
  2. If you wish to engage in profit-making activities using this service, or reproduce, sell, publish, or otherwise use information obtained through this service beyond the scope of private use, you must obtain prior written consent from the Company.

Article 8 Sending and Receiving Emails

  1. When members send and receive emails with the Company using this service, they shall use the email address registered with the Company in advance.
  2. The member who sends an email related to this service shall be solely responsible for the content of that email, and the Company shall bear no responsibility whatsoever.
  3. Members agree not to make any claims to the Company regarding the content of emails sent by other members.

Article 9 Amendment and Deletion of Information, etc.

The Company may amend or delete any text or other information provided by members to the Company or its website in connection with this service, without notifying such members or obtaining their consent.

Article 10 Prohibited Acts by Members

Members shall not engage in any of the following acts when using or in connection with the use of this service:

  1. Providing false information or information belonging to a third party when registering as a member or changing registration details.
  2. Infringing on the property, portrait rights, privacy, etc., of other members or third parties.
  3. Defaming or slandering other members or third parties.
  4. Using the Service by fraudulent use of a credit card.
  5. Participating in or promoting criminal acts.
  6. Acts contrary to public order and morals.
  7. Election campaigning or similar acts.
  8. Acts that obstruct the operation of the Service or damage our company's reputation.
  9. Altering information related to our company or the Service, or information provided through the Service.
  10. Transmitting or writing harmful computer programs, etc.
  11. Other acts that violate laws and regulations.
  12. Other acts that our company deems inappropriate.
  13. Acts that our company judges as likely to fall under any of the preceding items.

Article 11 Copyright

The Member agrees that all rights (including but not limited to copyrights) pertaining to the content provided through this service (images, text, designs, logos, videos, programs, edited works, etc.) (hereinafter referred to as "Content") shall belong to the Company.

  1. Copying, reproducing, quoting, diverting, altering, distributing, or providing links to this site without our permission is prohibited.
  2. Copying, reproducing, quoting, diverting, altering, distributing, or creating content that could be mistaken for ours is prohibited.
  3. Regardless of the purpose, if any unauthorized reproduction, reprinting, or other secondary use of our content, or any other act prohibited by domestic and international copyright laws, is discovered, we may take legal action.
  4. If a problem arises with a third party in violation of the provisions of this article, the member shall resolve such problem at their own responsibility and expense and shall not cause any damage, loss, or disadvantage to our company.

Article 12 Withdrawal

If a member falls under any of the following items, they shall lose their membership of this service and shall be automatically deemed to have withdrawn.

  1. If the Company revokes its approval of the member's admission
  2. If the member violates any provision of these Terms, and the Company determines that the member's continued membership is inappropriate
  3. If the member requests to withdraw from membership in accordance with the prescribed procedures

Article 13 Handling of Member Information

  1. Members shall provide accurate member information to the Company upon request for member information in the procedures outlined in Article 4 (Membership Qualifications and Application Procedures).
  2. If there is a change in the member information already registered with the Company, the member shall promptly notify the Company of such change by the method separately instructed by the Company.
  3. The Company shall manage member information and history information with the care of a good manager.
  4. Members agree that the Company may use or provide member information and history information to third parties for purposes other than providing this service, for the purposes specified in each of the following items.
  5. When the Company notifies members or users of additions or changes to this service, or for emergency contact, by email, postal mail, etc.
  6. When displaying information about the Company's services or the products, services, etc., of the Company's business partners that are deemed beneficial to individual members, on the Company's website accessed by the member or on the screen of the member's information terminal device.
  7. When the Company statistically analyzes member information to understand usage trends regarding this service and processes it into a format that cannot identify individuals for use or provision.
  8. When responding to legally mandated disclosure requests.
  9. When prior consent has been obtained from the member or user.
  10. Notwithstanding the provisions of paragraph (1) of the preceding article, if a member does not wish to receive information or inquiries from the Company using member information and history information, the member may notify the Company to that effect, and the Company shall endeavor to comply with such member's request. However, this shall not apply if such provision of information or inquiry from the Company is necessary in connection with the provision of this service to the member.
  11. When a member registers or provides information about a user to the Company, the member shall obtain the prior consent of the relevant user for the Company's use, disclosure, or provision of such information. In the event that such consent has not been obtained in connection with the use, disclosure, or provision of such information, or in the event that damage occurs to the user or a dispute arises with the user, the relevant member shall compensate for such damage or resolve such dispute at their own expense and responsibility, and shall not affect or cause damage to the Company in any way.
  12. If a member wishes to inquire about or change member information, the member may request such inquiry or change in accordance with the procedures separately determined by the Company. However, a member may not change their own name registered with the Company, except in cases of marriage or other changes of name based on legal grounds.

Article 14 Disclaimers

  1. The Company makes no warranties to members, including with respect to the completeness, reliability, and usefulness of the Service's system, the quality of the services provided, and information provided by the Company or third parties through the Service (including information contained in advertisements displayed on the network).
  2. The Company shall not be liable for any damages or disadvantages caused by system interruptions or delays, loss of data, unauthorized access to data, etc., due to failures of communication lines, computers, or other equipment, or for any other damages or disadvantages incurred by users in connection with the Service.
  3. The Company shall not be liable for any direct or indirect damages that members may suffer in connection with the use of the Service or as a result of actions taken by the Company in accordance with the provisions of these Terms, regardless of the nature or form of such damages. Members shall not make any claims against the Company in connection with such damages.
  4. In the event that any dispute arises between members or between a member and a third party in connection with the use of the Service by any member, the members concerned shall resolve the dispute at their own responsibility and shall not cause the Company to suffer any damage.

Article 15 Damages

If a member causes damage to the Company or a third party in connection with the use of this service, the member shall immediately compensate for such damage.

Article 16 Changes to, Interruption, and Suspension of Member Services

We may temporarily suspend or stop providing services to members without prior notice to members in any of the following cases:

  1. In the event of regular or emergency maintenance of the computer system (hereinafter referred to as the "System") used to provide this service:
    1. When System operation becomes difficult due to fire, earthquake, flood, lightning, heavy snowfall, power outage, natural disaster, or other acts of God.
    2. When System operation becomes difficult due to war, civil war, riot, disturbance, or similar events.
    3. When System operation becomes difficult due to System defects, unauthorized access by third parties, computer virus infections, or similar issues.
    4. When requested by administrative or judicial bodies based on reasonable grounds.
    5. In other cases where we deem it unavoidably necessary to suspend the System.
  2. We plan to add and change various services as our business progresses, and some of these added or changed services may be fee-based. However, members will be required to follow prescribed procedures when utilizing fee-based services.

Article 17 Purchase of Products

  1. Members may purchase products or services (hereinafter referred to as "Products, etc.") from the Company using this service.
  2. If a member wishes to purchase Products, etc., they shall apply for the purchase of products or use of services according to the method specified by the Company.
  3. In response to an application under the preceding paragraph, a "Order Confirmation" email will be sent from this site confirming receipt of the order and detailing its contents. However, this site's acceptance of the member's contract application is established when a "Order Shipped" email, notifying the member that the products have been shipped from this site, is sent to the member.
  4. Notwithstanding the provisions of the preceding paragraph, if there is any fraudulent or inappropriate activity regarding the use of this service, the Company may cancel or terminate the sales contract, or take other appropriate measures. The delivery of Products, etc. through this service is limited to Japan.

Article 18 Payment Method for Products

  1. The payment amount for products, etc. will be the total of the product purchase price including consumption tax, shipping fees, and other charges.
  2. Payment for products, etc. purchased through this service shall be made by credit card in the name of the member who is the purchaser, or by other payment methods separately approved by the Company.
  3. In the case of payment by credit card, the member shall abide by the terms separately contracted between the member and the card company. In the event of a dispute between the member and the credit card company, etc., both parties shall resolve the dispute.

Article 19 Returns and Exchanges

  1. Returns or exchanges of products shall be limited to cases where there is damage during delivery, defects in products, incorrect delivery, counterfeit products, pirated editions, or other causes attributable to us. Furthermore, returns/exchanges of such products or termination due to the inability to return/exchange products in the event of product defects shall only be accepted if the member contacts us within the period specified by us after receiving the products (unless otherwise stipulated by us in advance, within 7 days of the arrival of the products).
  2. Members shall apply for returns, etc. as stipulated in the preceding paragraph, in accordance with the procedures separately prescribed by us, and we shall bear all shipping costs for the products subject to such returns, etc.

Article 20 Disclaimer Regarding Products

  1. Unless otherwise specified, the warranty for products sold through this service shall conform to the content described in the attached product warranty card. We do not provide any other warranties for products sold through this service, including but not limited to their quality, performance, compatibility with other products, beyond what is stated in the product warranty card.
  2. We shall be exempted from liability if delivery problems arise, such as an unspecified delivery address, by contacting the member at their registered contact information and by arranging for the product to be shipped to the address specified at the time of purchase.
  3. Regardless of the legal cause of action, we shall not be liable for any damages, losses, or disadvantages related to the use of this service or products sold through this service, except as stipulated in the preceding article.

Article 21 Miscellaneous

  1. As a general rule, communication between the Company and members regarding the use of this service shall be conducted via the website at [fivestarcamera.net].
  2. Should any dispute arise between a member and the Company regarding this service or these Terms, both parties shall endeavor to resolve it through good faith discussions.
  3. If the dispute cannot be resolved through the discussions mentioned in the preceding paragraph, or regarding any other dispute concerning this service or these Terms, the Toyama Summary Court or the Toyama District Court shall be the agreed exclusive jurisdiction.

Article 22: Sales Prices and Product Information

  1. While we have made every effort to ensure the accuracy of the sales prices and product information displayed on our website, in the event of any errors, we reserve the right to correct them to the accurate prices and information.
  2. Please note that if you do not agree to proceed with the correct prices and information, we will, regrettably, cancel your order.

  1. All copyrights for information, documents, photographs, illustrations, programs, edited works, etc. (hereinafter referred to as "content") provided on [fivestarcamera.net] belong to Goyo Co., Ltd. (hereinafter referred to as "the Company").
